Policies
This
agreement has been set up to protect the rights and obligations of our customers
as well as Bindura Training Limited (trading as Totcars.com). For the
purposes of this agreement Bindura Training Limited and Totcars.com are
used interchangeably. This agreement is a legal document which sets out your
rights and obligations, and those of Totcars.com,
in relation to any services offered by us through this site.
Taxation
regulations
VAT
will be charged on all goods and services where applicable. All prices include VAT. If you want your
purchase to be delivered outside the European community, you are responsible for paying
the relevant duties.
English Law
Bindura Training Limited is a company registered in England, and every sale shall
be deemed to be performed in England;
English
law shall govern each transaction, including (without limitation) all
contractual and other relationships, which arise as a result of such sales.
Terms
Once
you have purchased any goods from the Totcars.com site, you are governed
by the terms of this
agreement.
The Contract
No contract exists
between you and Totcars.com until Totcars.com has confirmed
receipt and acceptance of your order. Totcars.com is entitled to withdraw from
any contract in the case of obvious errors or inaccuracies regarding the goods
or the order appearing on the site.
The Detail
We ask that you agree to
register for Totcars.com sales using
your correct name, address and any other requested details. You may also enter credit, debit or charge card details. You must ensure that
(a) you are entitled to use that card at the time when you provide those details to
Totcars.com,
and
b) the card has available funds to cover all
charges incurred at the time it is used
In
any event, to register for Totcars.com
services, you must legally be able to enter into contracts for goods and
services that you may buy here. You must be at least 18 years old and sane.
Corrections
and Errors
It
is important that you are aware that the colours and appearance of images may vary
from the way they appear on the screen.
Descriptions
of goods and services included in the Totcars.com
site are accurate to the best of our knowledge. Errors are corrected as soon as we are aware of
them.
Privacy
We ask you to enter your details for the purposes of purchasing only. We will
not sell your details or make them available to other companies.
We do not send random marketing emails to personal email addresses.
We conform with the requirements of the Data Protection Act 1998
We use cookies for the purposes of completing your order only.
Copyright
You
must not use, reproduce, modify or distribute our images or any part of those
images in any manner, whatsoever.

You agree that in any circumstances whatsoever, the liability of
Totcars.com under this agreement (whether arising in negligence or
otherwise), will not under any circumstances exceed the greater of a) £200 or
b) an amount equal to the sums paid or payable by you.
We
will not be liable to you or any third party for any indirect or loss or damage,
or for any loss of data, profit, revenue, business or management time, howsoever
caused.
Totcars.com is not
the manufacturer of the items sold and assumes no responsibility for any loss or
injury incurred while using the products.
Some products are
supplied direct from the
manufacturer or distributor.
Technical support is provided by the
relevant manufacturer or
distributor. Any problems arising
from these products will be resolved
by the respective manufacturer or
distributor.
The products should
be used only under strict adult supervision at all times.
Products should not be used by children under 3 unless stated.
Under no
circumstances should the products ever be used in areas where other vehicles may
be driving.
Under no circumstances should any product be used where there could be danger to
a child or adult.
Where the products
are purchased for use outside the European Community the electrical supply may
not be compatible with the products. The purchase of the relevant converters is
your obligation.
Where the product is
delivered to a UK address damaged we will cover the cost of return postage. If the
product is
returned for any other reason you will be liable for the cost of return postage.
You must sign that you accept
delivery of your product and that
you have checked it is received in a
condition you are happy with. We
cannot be held liable for damage in
transit if you have accepted
delivery unchecked.
If your product is damaged in
transit you must refuse delivery and
notify us immediately. We will send
a replacement to you.
The
couriers are contracted to deliver
to the kerb of the delivery address.
They are not contracted to carry the
product beyond the kerb and you may
be required to carry the item from
the kerb to your premises.
If your product
develops a fault that is covered by the manufacturers guarantee, the
manufacturers will replace the relevant part. You will be required to fit the
part where in the opinion of the manufacturers this requires no technical skill. The manufacturers will only
replace the product if in their opinion it cant be fixed. The manufacturers
warranty covers normal private usage.
If a product is damaged through user negligence or abuse the warranty will be
void.
Batteries are expressly excluded from any guarantee.
Under no circumstances can a refund be made on any used car.
If the product needs
to be returned to the manufacturer
for any reason postage costs will be
for your account.
If you request an
urgent delivery at an extra charge this extra charge is payable even if you
subsequently decide to return your product. We cannot refund urgent delivery
charges under any circumstances.
If you wish to
purchase a product for delivery outside mainland UK, we will obtain a
quote from reputable shipping companies and inform you of the cost or you can
use your own shippers. The importing of a product to a country outside mainland
UK is a transaction between you and the shippers. Although we may facilitate the
transaction we do not charge a fee for this and we pass on the shippers charges
at cost. If you need to return the product for any reason whatsoever your shipping charges
are not refundable and you will have to bear the cost of return shipping for the
product.
If your product has been sent to a location outside mainland UK and it is subject
to a warranty claim, you are liable for all shipping associated with getting it
fixed or replaced.
Where an offer to
beat other prices is made this applies to genuine normal prices quoted by UK
retailers for new goods taking into account all extra charges levied.
Beyond our control
Totcars.com shall not be liable for any failure to perform its obligations under this
agreement if caused by matters beyond our reasonable control.
Under no circumstances will compensation be payable should a delivery arrive
late or damaged. All goods are delivered by third party couriers and we are
reliant on them. We cannot accept any responsibility if they fail to perform.
Products delivered
require a signature to accept they
have been received in good order.
Delivered products must be inspected
before signing acceptance that they
are received in good order. If a
product arrives damaged the courier
must be notified immediately and the
product refused. We cannot accept
refund claims for goods damaged in
transit if you have signed your
acceptance they have been received
in good order.
Changes
to this Agreement
Price and
availability information are subject to change without notice.
Totcars.com
reserves the right to change the terms of this agreement from time to time, and
post a new version on our website. The new version will take effect on the day
it is posted on the website.
Severability
If any term in this
agreement is held unenforceable, the remainder of this agreement shall still
remain valid.
Suspension
or termination of the contract
Totcars.com reserves the right to suspend or terminate any members account which,
is, or appears to us in our absolute discretion, to be, in breach of any of the
provisions of this agreement.
